NOTICE OF PROPOSED AGENCY ACTION


The Florida Department of Environmental Protection (FDEP) gives notice that it proposes to approve a No Further Action Proposal with Institutional Controls and issue a No Further Action determination with conditions for a contaminated site. Florida Power & Light Company (FPL) is seeking this determination in reference to FDEP Facility ID # ERIC_14373, Graceville Substation located west of Highway 77 on the north side of 8 th Avenue in Graceville, Jackson County, Florida and intends to restrict exposure to contamination on the subject property in the following manner:


FPL has excavated to the extent possible and properly disposed of impacted soils upon the Restricted Property. The area of soil contamination as located on the Restricted Property shall be permanently fenced or covered and maintained with a minimum of two (2) feet of

clean and uncontaminated soil that prevents human exposure (hereinafter referred to as “the Engineering Control”). An Engineering Control Maintenance Plan shall be maintained that includes the frequency of inspections and monitoring and the criteria for determining when the Engineering Control has failed; and

Excavation and construction deeper than two feet below land surface is not prohibited on the Restricted Property provided any contaminated soils that are excavated are removed and properly disposed of pursuant to Chapter 62-780, F.A.C. and any other applicable local, state, and federal requirements. Nothing herein shall limit any other legal requirements regarding construction methods and precautions that must be taken to minimize risk of exposure while conducting work in contaminated areas. Nothing in this Declaration shall prevent, limit or restrict any excavation or construction at or below the surface outside the

boundary of the Restricted Property.


Complete copies of the No Further Action Proposal, the draft deed notice, and the FDEP’s preliminary evaluation are available for public inspection during normal business hours 8:00 a.m. to 5:00 p.m. Monday through Friday, except legal holidays at the FDEP, Northwest District Office, 160 W. TYPE OF BID

The contract shall be awarded to the lowest responsible and responsive bidder whose bid meets the requirements and criteria set forth in the Contract Documents and in this Invitation to Bid. The Contract will be awarded on a lump sum basis.

 

No bid may be withdrawn for a period of thirty (30) days after time has been called on the date of opening. A Bid Bond in an amount not less than 5% of the Base Bid must accompany bids and a Performance Bond and Payment Bond in an amount equal to 100% of the contract amount will be required of the successful bidder.

  

TIME OF 

SUBSTANTIAL COMPLETION

The time limit for substantial completion of this work will be 365 calendar days from the Date of Commencement.

CONTRACT

The successful bidder will be required to enter a written contract with the City of Jacob City Council Members consistent with the form contract to be provided in the Bid Documents.

 

OWNERS RIGHT TO REJECT BIDS

The Jacob City Council Members reserves the right to waive informalities in any bid, to accept and/or reject any or all bids, and to accept the bid that in their judgment will be in the best interest of the City of Jacob. All bids shall remain firm for a period of thirty days after the opening.

 

All bidders shall comply with all applicable State and local laws concerning licensing registration and regulation of contractors doing business to the State of Florida. City of Jacob encourages Minority Business Enterprises to respond to this Bid Invitation.


MINORITY 

PARTICIPATION GOALS

2. Whether the contractor provided written notice to a reasonable number of specific minority businesses that their interest in the contract was being solicited in sufficient time to allow the minority businesses to participate effectively.

3. Whether the contractor followed up initial solicitations of interest by contacting minority businesses or minority persons to determine with certainty whether the minority businesses or minority persons were interested.

4. Whether the contractor selected portions of the work to be performed by minority businesses to increase the likelihood of meeting the minority business enterprise procurement goals, including, where appropriate, breaking down contracts into economically feasible units to facilitate minority business participation.

5. Whether the contractor provided interested minority businesses or minority persons with adequate information about the plans, specifications, and requirements of the contract or the availability of jobs.

6. Whether the contractor negotiated in good faith with interested minority businesses or minority persons, not rejecting minority businesses or minority persons as unqualified without sound reasons based on a thorough investigation of their capabilities.


7. Whether the contractor effectively used the services of available minority community organizations; minority contractors’ groups; local, state, and federal minority business assistance offices; and other organizations that provide assistance in the recruitment and placement of minority businesses or minority persons.

This notice will serve to advise all residents of the Town of Noma that the following actions, if based on race, color, sex, national origin, religion, familial status (families with children), or handicap (disability) are prohibited by Title VIII of the Civil Rights Act of 1968 (Federal Fair Housing Act):


•Refusing to sell or rent to, deal, or negotiate with any person.
